Appeals
How to
Appeal
If you've had a judgment rendered against you or accidentally paid the wrong ticket, the consequences can be severe—including the loss of your driver’s license. In these situations, an appeal may be your only solution.
Not all cases qualify for an appeal, so it’s crucial to get professional legal advice. At Ticket911 our experienced lawyers will assess your case, evaluate your chances of success, and guide you through the process. With over 17 years of experience as prosecutors, Avi Levy and Bernard Levy-Soussan have successfully helped drivers remove demerit points and overturn unfavorable judgments. Appeals typically arise from two common scenarios:
1. You Paid a Ticket by Mistake
Paying a ticket is legally considered an automatic admission of guilt, leading to a judgment against you. Many drivers find themselves in this situation due to:
Miscommunication with a spouse, employee, or employer
Accidental payment of the wrong ticket
A simple moment of distraction
We’ve handled countless similar cases and know how to appeal and reverse these judgments
2. You Lost Your Case in Court
Perhaps you represented yourself, believing you had a strong defense, but the judge ruled against you. Or maybe you hired a lawyer but didn’t get the results you expected. Either way, we can review your case and fight for a better outcome—without you having to appear in court.
Act Now!
The deadline to file an appeal is 30 days from the date of judgment. Our legal team will ensure all procedures are completed within this timeframe, including:
Drafting & Filing Appeal Documents
Ordering Court Transcripts
Conducting Legal Research
Presenting Your Case in Court
Once an appeal is filed, the original judgment is temporarily suspended, and your demerit points may be reinstated until a final decision is made. This means you retain your driving privileges while the case is under review. However, not all Highway Safety Code decisions can be appealed—for example, decisions related to restricted licenses (Articles 118 & 121 of the Code) cannot be contested.
The legal system is complex, and appeals require strategic legal expertise. Our dedicated team of lawyers, paralegals, and administrative professionals is ready to fight for you. We provide legal services across Quebec, Ontario, Alberta, and New York State.
